Agreement with Terms and Conditions By visiting our website as well as placing an order, either on-line, via fax or telephone, indicates you expressly agree to be bound by and adhere to all the terms and conditions detailed herein, as well as all applicable laws and regulations governing this website. If it is deemed that these terms and conditions have been violated, Kickin’ Tickets, inc may without warning terminate your use of the website barring all future access, cancel your ticket order, as well as take appropriate legal action and remedies available.

General Company Info Kickin’ Tickets, inc is an independent, privately owned ticket brokerage company servicing corporate and individual clients around the world with admission tickets to all concerts, theater and sporting events. We are licensed in the State of FL and bonded to insure complete customer confidence and peace of mind. We specialize in providing premium and hard to find tickets for events, with the highest level of customer service in the industry.
We are not affiliated with any box office, promoter, venue, theater, stadium, sports team, or sporting association. Any and all copyrights, trademarks, trade names, references to specific events, and/or photographs used by us are for identification and descriptive purposes only. It is not intended to imply nor should it be understood that we are endorsed or sponsored by the organizers and/or sponsors of any event listed within this website unless expressed otherwise.
Event Details All event dates and times are listed as local for the city in which the event takes place. They are published on our website and printed on the face of the tickets; however, they are always subject to change. This is especially true for sporting events that are subject to television scheduling conflicts. It is the responsibility of the customer to verify this information prior to the event, and is suggested that you frequently contact the official website of the performer or event and/or call the venue to ensure you arrive at the correct time and date.
Some events and venues enforce age restrictions (i.e. 21 and over). It is the customer’s responsibility to determine whether such a policy exists prior to purchasing tickets, and if it would affect your admittance. We cannot be liable for refusal of attendance based on this type of restriction. Furthermore, we cannot be held responsible for providing information or instructions regarding particular event or venue policies. It is suggested that you go to the official website of the performer and/or venue for any specific policy that could affect you.
Some events have adult themes and are not appropriate for children and others. It is the customer's responsibility to determine whether the content of an event is appropriate for themselves or others in their party. We cannot be held responsible for the activity that occurs during an event. There will be no refunds, credits, or exchanges for any of these circumstances.
Venue Details We aim to supply all vital venue information and event specifics to help users make an educated buying decision. This includes the venues’ contact information, website links, the various seating chart configurations and seating details. Countless hours have gone into compiling all this information from many sources and is continually updated when changes are made public. While we make every effort possible to be precise and accurate with this information, changes made by the promoter, band or venue without our knowledge do happen from time to time. We cannot be held liable for changes made to the layout of the stage or seating configuration, and the customer assumes full responsibility for the final venue layout.
Ticket Prices All tickets are listed as price per ticket in U.S. dollars. The majority of the tickets we offer are sold for more than the price printed on the ticket. We acquire our inventory through a variety of methods including, but not limited to, season ticket holders and individuals with extra tickets to an event. There is no direct relation to the price listed on our website and the price printed on the ticket. Prices on our website are listed at market value, which is generally greater than face value (the price printed on the ticket). Pricing can vary greatly from one event to another. The posted prices reflect the cost and difficulty of obtaining the tickets, supply and demand, as well as other conditions.
Service Fee A service fee is added to all orders. This charge covers the costs for services required in securing your tickets, processing your order and subsequently ensuring you receive the highest level of customer service.
Low Price Guarantee The low price guarantee is valid only at the time of purchase. The free shipping offered is FedEx 3-Day service. If this shipping option would not get the tickets to you in time for the event, then the customer would be responsible to pay for the upgrade in shipping service. Because ticket prices and selection fluctuates, no price matching is offered after an order was placed. The price is defined as the total cost for your order - this includes the price for the ticket, service fee and shipping charges. In order to receive a price adjustment, the order must be placed over the phone so a customer service representative can verify the competitor's published price and fees. Competitors' prices must be for the same tickets (section, row and seats) for the same exact event and must be able to be verified by one of our customer service representative from their website. Price matching only applies to other online ticket brokers. It does not apply to primary ticket outlets, including but not limited to Ticketmaster, Tickets.com, venue box office, etc.
Ticket Availability Due to the demand of most events, ticket availability and prices cannot be guaranteed until an order has been confirmed and payment has been made. Inventory and the price of tickets may even change within the same day.
Some tickets that have been secured for sale have not yet been received within our offices; thus not ready to ship. If more than 7 business days will pass between order placement and ticket shipment, one of our customer service representatives will contact you to provide an estimated shipment date.
The quantity of each set of tickets listed on our website contains adjoining seats unless otherwise noted. Tickets are normally available only in even numbered quantities (2, 4, 6, etc.) unless otherwise noted. If you are searching for an odd number of tickets (1, 3, etc.), it is best to speak to one of our customer service representatives who will help you find the requested seating location and quantity of tickets.
All tickets listed are either traditional hard stock (smaller cardstock tickets) or electronic tickets (i.e. TicketFast, E-Tickets, etc.). All tickets ordered will be either of these two forms which are valid for admittance into the event. If the tickets you order are electronic tickets, they are printed by the company on 8 1/2" x 11" paper and shipped to the customer to maintain the authenticity of the tickets. If there is a strong preference on which type of ticket you want to receive, you must contact a customer service representative to place your order over the phone and informing them of your preference. All on-line orders are fulfilled with whichever ticket type we have available. The integrity of all our tickets are guaranteed.
Parking Passes When the listed section or row states “Parking”, “Prk”, “pkg”, or anything of the like, it's only a parking pass and not a ticket for admission. You will have to purchase tickets for the event separately if needed.
Payment Methods We accept Visa, MasterCard, American Express and Discover on-line through our website and over the telephone. Debit cards are accepted only if they bear the Visa logo. Electronic funds transfer is also available from your bank to ours. International orders are accepted only if the credit card being used supports AVS (Address Verification Service). Payment by cashier's check, money order, or company check is an option for only established corporate accounts.
Placing an order through our website acknowledges that you hereby authorize Kickin’ Tickets, inc to charge your credit card for this order and subsequent phone purchases. Purchases by credit card do not grant any variances from these terms and conditions. You are still responsible for complying with our policies in their entirety.
Any attempts to defraud us, or your credit card company, will result in legal action brought against you. It is a violation of the law to place an order in a false name or with an invalid credit card. Be aware that if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you; and that fraudulent orders will be prosecuted to the fullest extent of the law.
Order Processing To avoid any delay in processing and shipping your order, your name and billing address must exactly match the information on file with your credit card company or the transaction will be denied, as this information is verified to protect the cardholder. If the addresses don’t match, your order will be placed on hold until a customer service representative can contact you for the correct address information; which will cause a delay in processing the order, and could result in the requested tickets being no longer available.
We reserve the right to request a Credit Card Authorization Form at our discretion. When required, it is done to protect both the cardholder and the company from fraudulent use. If such documentation is requested and not supplied, the order would be cancelled.
Due to the nature of the industry, all tickets are subject to availability. Occasionally, the tickets requested may no longer be available at the time the order is received. If equivalent or better seat locations are available at the same price, and you have chosen to be automatically upgraded, we will fill your order with the alternative tickets. If this situation occurs, your credit card will be charged and you will be contacted for notification of your new seat location. If you have chosen to not be automatically upgraded, and the requested tickets are no longer available, a customer service representatives will contact you to discuss alternative seat locations, and your credit card will not be charged until we have received authorization from you to fill the order with alternative tickets.
In the event that inventory is listed with incorrect price or description generated from a typographical error or incorrect information received from our suppliers, we reserve the right to cancel that order.
Once an order has been placed and processed, there are no refunds, cancellations or exchanges. We reserve the right to refuse or cancel an order and give a full refund at any time, for any reason.
Pre-Orders “Pre-Orders” are defined as tickets that are purchased by a customer in advance which are not currently in stock. Exact seating locations may not yet be available so orders are taken for general or approximate seating locations. Once the tickets are received, they will be immediately shipped. In some cases deliveries are not made until the week or less of the event, however, they are guaranteed to be delivered in time for the event.
Pre-orders require full payment at the time of the order, as well as under certain circumstances a Credit Card Authorization Form to be signed by the credit card holder and faxed back to us along with a copy of the credit card (front and back) and drivers license. Upon payment, your order is guaranteed as well as the price.
If for some reason we are unable to deliver the particular tickets you originally pre-ordered in time for the event, we reserve the right to upgrade the order to a comparable or better seating location at no additional cost to you.
Sales Tax By State law we are not required to collect any sales tax.
Laws & Regulations Kickin’ Tickets, inc abides by all local, state, and federal laws. Certain States have restrictions in regards to the reselling of event tickets which limits the method, as well as possibly other factors in which a transaction can occur. For some states or municipalities, we may only offer ticket/travel packages that include event tickets and one or more of the following: party, dinner, transportation and/or accommodations. Though all users can view our complete inventory on-line, depending on the State in which you reside, and the location of the event, local laws may prohibit us from fulfilling your order. If processing your order request would result in violating a particular law, one of our customer service representatives will contact you to discuss the reason your order was cancelled.
On-Line Order Confirmation Ticket prices and availability are not guaranteed until an order is processed. When you receive an order confirmation from the website after submitting your purchase, it does not mean that the order has been processed. Your submission is an order request that will be processed and fulfilled by one of our customer service representatives during normal business hours. Once completed, you will be notified via e-mail and/or telephone with the tracking number of the package.
Your order may be processed without receiving an invoice or an updated status from us. If this occurs, please contact our office to check the status of your order. Never make an assumption regarding the status of your order simply because you have not been contacted by us. Orders may not be cancelled due to any problems with receipt of emails.
In rare cases we must sell a full set of tickets together. (i.e. you might not be able to order a pair from a listed four-pack of tickets.) If this happens to be the case with your order, we will inform you before it is processed, and the order will be cancelled if we cannot provide you with a suitable replacement.
Will-Call / Pick-Up If your tickets need to be picked up at the Box Office or another designated location, you are required to fill out a Credit Card Authorization form and fax it to us along with a legible copy of your driver’s license and credit card (front and back) used. This is done to protect both the cardholder and company against fraudulent use. Your order will not be processed and the tickets are not guaranteed until this documentation is received.
We are not responsible for tickets left at will-call or any other location if client fails to pick them up. Please call one of our customer service representatives immediately if your tickets are not at will-call or other designated location.
Ticket Shipping Shipping estimates are from the time your order has completed processing - not from the time your order request is placed on-line. Orders are typically processed and shipped within 24-48 hours from receipt of an order. In cases of delayed printing from the ticketing agency, tickets may not be delivered until very close to the date of the event, however, they are guaranteed. You can contact our customer service department at any time to check the status of your order and the estimated ship date. All tickets shipped are guaranteed to be delivered in time for the event.
While at times an alternative shipping method may be used, Federal Express has been chosen as our primary shipping provider because of their proven reliability, security and speed. Since the majority of orders are shipped via Federal Express, orders cannot be shipped to a PO Box address.
For your protection, be aware that we require a signature on all deliveries. If you desire, this requirement can be waived by faxing us a Credit Card Authorization form with a copy of your driver’s license and the front and back of the credit card being used. Note however that by removing the signature requirement, you are accepting 100% liability if the package is lost or stolen and releasing all rights for a refund or charge-back from your credit card company. Furthermore, if you have a signature release on file with Federal Express they may leave the package, and by this being done, is binding you to accept 100% liability and we cannot be held responsible if the package is lost or stolen.
We do not allow any re-routing on a package. If you have any specific delivery requirements please make those arrangements when you place the order to ensure proper delivery.
A $15.00 fee will be automatically charged to the credit card used for the order for shipments that are automatically re-routed by the courier due to an incorrect address supplied by the customer. Errors such as incorrect zip code, incorrect or missing apartment number, or other addressing errors results in additional fees charged to us from the courier, which in turn will be passed on to the purchaser.
All tickets are sent to your credit card billing address, unless requested otherwise. If you are wanting to ship your order to an alternate address, you will need to fill out a Credit Card Authorization form and fax it to us with a copy of your driver’s license and the front and back of the credit card being used to complete order processing. This is to protect the card holder from fraud and assures that we are shipping to the correct location. If this documentation is requested and not provided in a timely manner, the order will be cancelled.
You agree to hold us harmless from any resulting claim, or attempt a refund or charge-back through your credit card, for tickets that are delivered late or not at all due to incomplete, inaccurate or missing address information supplied by you at the time of the order.
Once your order has been shipped, you will be notified via e-mail and/or telephone of the expected delivery date and the tracking number so you have the ability to check the status en route. If you do not receive the tickets within the expected delivery date given by us, you must call or e-mail our office so we can track your shipment and resolve any possible problems.
Shipping Problems If your tickets are lost in transit or damaged beyond use, we will replace the order with comparable or better seats, or issue a full refund. However, once delivery has been confirmed by the courier, the tickets are your responsibility. It is recommended to have the tickets shipped to a location that will ensure you do not have any delivery problems. To help ensure there are no problems with delivery, we are able to ship the tickets to any location you specify.
Undeliverable / Refused Shipments If for any reason your tickets are returned to us or could not be delivered, we will try to contact you to arrange another delivery attempt, and a second delivery charge would apply. Additionally, the customer will be automatically charged the cost for the tickets to be returned to us. If after the second delivery attempt fails, or you refuse the delivery, the tickets will be relisted for sale through our resale department. They will act as your agent to attempt to recover some, if not all of your costs. You have the right to set the selling price for your tickets; however, if no communication can be made, the resale department will price the tickets as they see fit in an attempt to recover as much of your money as possible. The standard consignment fees apply to this type of transaction. Once the tickets are resold, you will be issued a company check for the selling price you requested minus the consignment fee. It is important to know that all sales are final; and that by directly or indirectly refusing the package is not grounds for a refund or charge-back from your credit card company.
Incorrect Tickets Upon receiving your tickets, check them immediately to verify the event, date, time and seat location match your order. If the tickets you receive are in error, you must contact us within 48 hours from receipt of package to correct the matter. Otherwise, because of the nature of the industry, we cannot be held responsible nor able to correct the problem. If brought to our attention within the allotted time frame, one of our customer service representatives will give instructions for returning the tickets, at our expense. We will then do our best to fill the original order, or if unable to supply the originally ordered tickets, you will be given the option of canceling the order with a full refund or accepting comparable tickets.
Lost Or Damaged Tickets After Delivery Since we are not the original source of the tickets, we are unable to reprint or reissue tickets. We cannot issue replacement tickets should yours become lost, stolen or damaged after they have been received by the customer. Upon receiving the tickets, it is your responsibility to keep them in a safe, secure place until the event. Tickets should not be left in direct sunlight, extreme heat or high moisture, and protected from liquids and other harmful agents, as they can damage tickets to the point of rendering them unusable.
Cancelled & Rescheduled Events Tickets for all events are standardly considered as "rain-or-shine" final purchases.
The full purchase price of the ticket minus any shipping fees will be refunded to the customer if the event is officially cancelled and has not been postponed or rescheduled.
In order to issue a refund, we must receive the unused tickets in their original condition within 10 business days from the official announcement of cancellation, or original event date - whichever occurs earlier. Once the tickets have been received, issuance of refund will occur no later than 30 days thereafter either in the form of a company check or credited back onto the customer’s credit card at our discretion. When returning tickets back to the company, it is at the customer’s expense. It is highly recommended that some form of trackable shipping with a signature requirement is used (i.e. Federal Express, UPS, Certified Mail, etc.). If the tickets are not shipped back to us in the allotted time, or are lost in transit, no refund can be issued. If after 10 days of the original event date passes, you may need to return tickets directly to the box office for a face value refund only.
In cases of a rainout or strike for a sporting event, no refunds will be made. You must exchange the ticket at the venue for a seat to a future game that is still available.
There are no refunds or exchanges for postponed or rescheduled events, time changes, or cancellations due to acts of God (rainout, earthquake, flood, etc.), war, terrorism, strike or lockout. Tickets for postponed events will be valid for the new date and/or time. If you cannot attend the new date or time, we can attempt to resell your tickets through our resale department. If for some reason, the venue or promoter announce that the original tickets are not valid for the new event time or date, those tickets will be treated as a cancelled event.
We cannot be held responsible for providing information regarding particular event changes. It is suggested that you frequently visit the official website of the performer or event and/or call the venue for any official announcement of any cancellation or postponement.
Partial Event Cancellations If multi-day events such as tennis or golf tournaments have one day's play cancelled or postponed, tickets purchased for that date may not be honored for another day's play or redeemed for tickets that would, nor are there any refunds given for this situation. The same applies to partially rained-out events. If any part of a day's scheduled event occurs, a full day of the event will be considered to have taken place.
Customer Cancellations Due to the volatile nature of the industry, there are no customer cancellations, refunds or returns or exchanges of an order once placed. As with all ticket agencies, all sales are final. Upon request we are able to attempt to resell your tickets through our resale department.
Consignment If you are unable to attend an event which you have tickets for (either bought from us or through another source), or have extra, we are able to help you resell your tickets on a consignment basis. Our resale department will act as your agent to assist in recovering some or all of your costs, and more often make profit. Before we can advertise your tickets, we must receive a signed copy of the Ticket Resale Agreement form and the tickets to verify their authenticity. All details and policy are covered within the Ticket Resale Agreement, and by signing you are agreeing to its entirety. It is always in your best interest to remain in close contact with our resale department regarding the pricing of your tickets and all other pertinent issues. You have the right at any time prior to the event date or reselling of the tickets to request the tickets be sent back to you. You must take into account any potential delays, such as adverse weather conditions, as our resale department is not responsible under any circumstances for the timely delivery of your tickets. We make every attempt possible to sell consignment tickets ahead of any other tickets listed for that event.
Transportation Kickin’ Tickets, inc cannot be held responsible for damages, delays, cancellations or unavailability of transportation caused by an act of God, war, riot, civil commotion, act of State, strikes, fire, flood, restricted availability, or any other occurrence beyond the control of Kickin’ Tickets, inc.
Disputes If there is any dispute about or involving Kickin’ Tickets, inc, by use of the website or telephone services, you agree that the dispute will be governed by the laws of the State of Florida, United States of America, without regard to its conflict of law provisions. You consent and submit to the exclusive jurisdiction of the State and federal courts located in the State of Florida, United States of America, in all questions and controversies arising out of your use of this website, our services and this agreement.
Limitation of Liability Any user of KickinTickets.com agrees that it is at their own risk. Customers are responsible for protecting the confidentiality of log-in password(s). Neither us, our affiliates, nor any of our officers, employees, third party content providers or licensors, warrant that KickinTickets.com's service will be uninterrupted or error free. Nor do we make any warranty as to the results that may be obtained from use of this website, or as to the accuracy, reliability or content of any information, or service provided throughout.
In no event will we, or any person or entity involved in creating, producing or distributing KickinTickets.com be held liable for any damages, including without limitation, direct or indirect, incidental, special, consequential or punitive damages arising out of the use or inability to use the website.
We, or none of our employees are responsible for any errors or delays in responding to an order caused by an incorrect e-mail address provided by you or other technical problems beyond our control.
Neither us, nor our affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of the information contained within the website, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising there from or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages.
In the unlikely event that we are unable to fulfill the full quantity of tickets ordered, our liability is limited to returning to the customer any payment previously made for the undelivered tickets.
We are not responsible for any delay causing you to arrive late or miss your event for any reason. Any actions by us that result in you missing the event will be rectified with our liability not exceeding your total purchase price.
We are not responsible for the conditions or actions of the crowd or personnel at any event. The tickets that you purchase from us are valid and if someone is sitting in your seat when you arrive, it is your responsibility to ask them to move or ask an usher to seat you.
In the event that we are required to seek legal remedies to recover fees and/or resolve disputes, you agree that we are entitled to recover all costs associated with such actions caused by the customer, including but not limited to, all reasonable attorney and administrative fees.
All users of this site, and customers, from both on and off the Internet, agree to waive any additional rights or remedies conferred upon it now or in the future under Florida law.
